This decision provides important insight into your family and property rights. Here is what it changes for you.
The situation
Under Article 14 of the French Code of Civil Procedure, from which Article L. 20, II, of the French Electoral Code does not derogate, no party may be judged without having been heard or summoned. Accordingly, a tribunal that dismisses the application of an elector with which it was seised on the same day violates these provisions, where neither the terms of the judgment nor the case documents show that, before ruling, it held a hearing of which the applicant had been given notice, or that it applied the provisions of Article L. 212-5-1 of the French Code of Judicial Organisation and Articles 828 and 829 of the French Code of Civil Procedure.
What the law says
This decision confirms the fundamental principles of property law.
