This decision provides important insight into your family and estate law rights. Here is what it changes for you.
The situation
Article 510-1 of the Civil Code does not provide for automatic nullity in respect of acts of disposal made by an adult under curatorship without the assistance of their curator — unlike Article 502 of the same Code, which governs acts made by an adult under full guardianship — and leaves the judge the discretion to assess, in light of the circumstances of the case, whether or not to declare the nullity.
What the law says
This decision confirms the fundamental principles of property law.
Key points to remember
- Strictly observe the statutory time limits for lodging an appeal
- Keep all your supporting documents (title deeds, legal instruments, correspondence)
- Plan ahead: preventive legal advice always costs less than litigation
