Buying a house with separate funds

Pierre and Sophie, married under community of acquests, buy a €250,000 flat in Montpellier. Pierre uses €100,000 from an inheritance he received before marriage as part of the down payment, but the deed does not mention this.

The court confirmed that without a notarial declaration of reinvestment, the inheritance remains separate property. Pierre must immediately ask the notary to record his separate funds in the property deed, and keep proof of the inheritance and bank transfers. This avoids the amount being treated as community property in a divorce.

Renovating inherited property during marriage

Marie inherits a run-down villa in Nice worth €300,000 while married to Jacques under separate property. They spend €80,000 of Jacques's salary on renovations. Now separating, Jacques claims half the villa's increase in value.

Application pratique:

The case law stresses the importance of documenting contributions. Marie should have signed a written agreement recognizing Jacques's investment as a loan or a right to reimbursement, not an ownership stake. Without it, Jacques can only claim the €80,000 plus possible revaluation, but not half the property. They must now negotiate or litigate based on actual financial contributions.

Lucas and Amélie, married under community of acquests for 15 years, divorce in Lyon. Lucas started a successful marketing agency during the marriage, worth €500,000. Amélie helped informally but her name is not on the business.

The court confirms that business value created during marriage is community property, even if only one spouse is the official owner. Amélie is entitled to half the agency's value at divorce. Lucas cannot sell or hide assets. Practical steps: get a professional valuation of the business, and have a notary draft a liquidation agreement.
